The Role As Bankruptcy and Consumer Finance Regulatory Senior Counsel on the Regulatory Legal team in Capital One's Legal Department, the attorney in this position will work closely with a number of Capital One's bankruptcy operations teams within the business lines, Compliance, and across the Legal Department to provide legal guidance, to ensure compliance with internal policies and procedures and bankruptcy laws and regulations, and manage litigation risk. The Bankruptcy Senior Counsel will serve as the primary bankruptcy counselor advising Capital One's Financial Services's (FS) bankruptcy operations groups and related support groups and be responsible for providing strategy and overseeing various bankruptcy issues relating to auto loans, including, but not limited to, automatic stay, lien perfection, proofs of claim, dischargeability and other secured transaction litigation, along with other consumer regulatory areas and bankruptcy litigation for the business line operations they support. The Bankruptcy and Consumer Finance Regulatory Senior Counsel will work closely with one other Bankruptcy Senior Counsel supporting Capital One's Card and Retail Bank, Small Business, and Commercial businesses and other support groups to help advise on and implement best practices at an enterprise level. In addition, the Bankruptcy and Consumer Finance Regulatory Senior Counsel will be the subject matter expert supporting levies and garnishment and sworn documents across the company. The Senior Counsel will be part of a larger, dynamic, and energetic team supporting customer communications, marketing, and digital consent and agreements and report to the Senior Director, Associate General Counsel.This role requires an attorney with experience in business and/or consumer regulatory and bankruptcy law, preferably Chapter 7, Chapter 11, or Chapter 13 related litigation. The role requires an attorney with intellectual curiosity, a desire to learn new areas of law, and an interest and an ability to analyze and interpret laws, regulations, and other source documents covering many different areas of the law. This role also requires an attorney with a strong interest and proficiency in the use of modern technology, and with strong analytical, organizational, and prioritization skills. Additionally, this role requires an attorney possessing excellent verbal and written communication skills, attention to detail, the ability to interact with and influence associates across departments and job levels, and the ability to work effectively in a fast-paced environment, with minimal supervision, while managing large volumes of work including complex legal issues that may arise suddenly. Responsibilities: Serve as the legal counselor advising Capital One FS bankruptcy operations, and related support groups (e.g., Legal, Compliance, Risk, Audit, and Quality Assurance)Support the bankruptcy operations groups as an integral member of their operational and risk management processesProvide strategic and proactive leadership on trending legal and regulatory issues affecting the supported businessesEnsure timely identification, mitigation, resolution and reporting/escalation of existing and emerging legal issues and risksSupport the development, marketing, and rollout of new products, services, and other innovations impacting customers being serviced by the supported bankruptcy operations groupsReview internal policies and procedures and advise Capital One's bankruptcy operations groups on best practices, policies and proceduresAdvise applicable businesses on defensive levies and garnishment issuesAdvise all business lines on sworn documents issuesBuild and maintain effective working relationships with internal and external stakeholder groupsIf not located in Plano, travel to Plano will be required at least quarterly and perhaps more frequently initially to build relationships A successful candidate will have: Deep expertise in commercial and/or consumer bankruptcy laws and regulations affecting secured auto loans, unsecured loans, lines of credit, and other banking products and servicesAt least 2 years of robust bankruptcy legal experience, including, but not limited to, litigation, proofs of claim, dischargeability, restructuring, and/or other commercial and/or consumer regulatory, loan, and other banking-related bankruptcy litigationFinancial services industry knowledge and expertise, including experience with business and/or consumer regulatory requirements relating to auto loans, credit cards, lines of credit, loans, and other banking products and servicesAbility to work in a fast-paced environment with minimal supervisionAbility to manage a large volume of work, including complex legal issues that may arise suddenlyAbility to thrive in an environment primarily defined by close collaboration with the businesses and Legal and Compliance colleagues to solve complex legal issues and to develop and effectively communicate guidance and adviceAbility to think creatively about how to most effectively and efficiently deliver legal advice and improve current processesAbility and willingness to work as a team player, with comfort interacting with associates across departments and job levels, both inside and outside the Legal department Basic Requirements: Juris Doctor from an accredited law schoolActive member in good standing of at least one state barAt least 4 years of experience as an attorney in a law firm, in-house legal department, or government agencyAt least 3 years of experience working with business or consumer bankruptcy laws impacting banking products Preferred Requirements: 5+ years of law firm, in-house legal department, Chapter 7 or Chapter 13 trustee representation, bankruptcy restructuring, secured transactions, or government experience in an attorney role3+ years of experience working on commercial or consumer regulatory matters3+ years of experience as an attorney within a regulatory environmentA thorough knowledge of consumer protection laws, including TILA, ECOA, UDAAP, FCRA, FDCPA, SCRA, Dodd-Frank Act, and other accompanying regulatory consumer lending regulationsExperience or familiarity with levies and garnishment and/or sworn document lawsExperience with Google Workspace and Salesforce At this time, Capital One will not sponsor a new applicant for employment authorization for this position.
