Bankruptcy Paralegal Location: 99 NE 4th Street, Miami, FL 33132 Status: Full-time (On-Site) Position Description: This position is in support of our customer, the U.S. Attorney's Office, Southern District of Florida. The scope of work includes working independently to resolve the majority of the Chapter 7 and 13 matters in which the U.S. has an interest, and to provide paralegal support to Assistant U.S. Attorneys (AUSAs) representing the government's interest in adversary proceedings and Chapter 11 bankruptcy proceedings filed in the U.S. Bankruptcy Court for the Southern District of Florida. May also be called upon to assist other AUSAs and other support staff handling general civil, affirmative or financial litigation cases. Required Qualifications: •Possess a paralegal certificate•At least five years of paralegal experience with civil collection or bankruptcy litigation including some trial related experience•Sound working knowledge of legal system, legal research procedures, and sources of information•Excellent written and oral communication skills, analytic ability, and thorough knowledge of legal research tools•Hands-on familiarity with a variety of computer applications, including word processing, database, spreadsheet, and telecommunications•Ability to consistently deliver highest quality work under extreme pressure•Knowledge of principles, concepts and methods of legal research and analysis sufficient to perform assigned case development•Knowledge of the litigation process, local court rules and court procedures to perform assignments such as reviewing incoming documents and determining the need for the preparation of various legal documents•Knowledge of legal terminology•Knowledge of applicable automation support hardware and software to automate various legal and office support functions and to perform data retrieval from various legal and administrative subject-matter databases•Skill in operating a computer terminal, personal computer, and electronic typewriter•Familiarity with office machines sufficient to perform recurring operations as well as user-selected custom features, e.g., copy enlargement and reduction•Ability to obtain/maintain a U.S. Department of Justice (DOJ) clearance which requires U.S. citizenshipEssential Functions:Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions.•Monitors U.S. Bankruptcy Court Calendars in Miami, Fort Lauderdale and/or West Palm Beach and works with federal agencies to identify those cases on the calendar with a federal interest•Reviews referrals from IRS Insolvency Unit to determine if the referral is complete or whether information is missing from the referral•On own initiative, coordinates between personnel in the IRS insolvency unit and debtor's counsel in order to resolve issues in Chapter 7 and 13 matters and bring those matters to a favorable conclusion for the government•Communicates directly with debtor's counsel to continue hearings scheduled in U.S. Bankruptcy Court•Coordinates with federal agencies and, independently determines if additional information is needed from the agency in order for the AUSA to effectively represent the government's interest in U.S. Bankruptcy court, state court, and U.S. District Court•Prepares recurring and special reports (e.g., status of bankruptcy cases and accomplishments/results) as well as quarterly reports on recoveries and other pertinent information concerning bankruptcy litigation•Analyzes the bankruptcy filings of debtors, performs independent legal research, and drafts responsive filings that set forth the government's position. Although the filings are ultimately reviewed and approved by an AUSA, incumbent independently performs legal research and drafts the filings•Examines and/or drafts a variety of legal documents including but not limited to answers, responses to objections to claims, objections to confirmation, motions, orders and other pleadings to be filed in bankruptcy court. Ability to investigate the facts and accurately summarize the facts in legal documents and ability to apply the law to the facts in the case•Works with agency personnel to draft discovery requests and responses in adversary proceedings in U.S. Bankruptcy Court•Provides assistance to AUSAs preparing for hearings and trials in U.S. Bankruptcy Court, state court, and U.S. District Court•Ability to meaningfully assist AUSAs at depositions, hearings or trials by assembling, organizing and marking exhibits and retrieving the correct exhibit for the AUSA during the deposition, hearing or trial•Maintains calendar of active cases in U.S. Bankruptcy Court in which the U.S. has an interest, including but not limited to due dates for pleadings and hearings/trials•Calendaring the deadlines for and assisting AUSAs in preparing initial disclosures, expert disclosures, pre-trial disclosures, joint pre-trial stipulations, exhibit notebooks, and objections to exhibits in adversary proceedingsWork Conditions:•Work is primarily performed in an office environmentThis document is not intended to cover or contain a comprehensive listing of all job-related activities, duties or responsibilities that are required of the employee.
