Senior Legal Counsel, Wealth & Personal Banking ("WPB") - Digital and Deposits
Description This position provides legal advice, guidance and support to HSBC Bank USA, N.A.'s Wealth & Personal Banking ("WPB") business, including the digital and mobile channels, to ensure that exposure to legal risk is managed. Role ContextThe jobholder assists the Head of the WPB Payments, Deposits & Bank Operations Legal Team in managing legal risk across the lines of the WPB business, including the digital and mobile channel teams, and support functions in accordance with established policies and procedures. The diversity of HSBC's business, its geographic spread and the constant changes internally and externally means the diversity of matters which the jobholder is required to manage and advise on is very wide. The role requires an understanding of the structure of the HSBC Group and its culture and the ability to handle increasingly complex legal issues. The jobholder must also establish close mutually supportive working relationships with other members of the US Legal team and the Global Legal Function. Works largely autonomously, but seeks management input from the Head of the WPB Payments, Deposits & Bank Operations Legal Team on unusual situations, highly complex issues, and matters that may pose significant legal, financial and /or reputational risk to the Company. Impact on the BusinessProvide counsel and legal support on a variety of legal matters, including matters pertaining to the law of Bank Deposits & Collections, Advertising, E-Sign and Operations that may be complex or may have some material impact to the WPB business, including the digital and mobile channels. Advise the WPB business and digital and mobile channel teams by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner. Provide support and guidance to the WPB business and digital and mobile channel teams with regard to legal risks arising in jobholder's area of expertise. Customers / StakeholdersProvide prompt, commercial, practical and sometimes complex and/or specialized legal advice to the WPB business and marketing teams. Be pro-active in the provision of legal support and in advising the WPB business and digital channel teams promptly of material legal developments and their implications. Ensure the Head of the WPB Payments, Deposits & Bank Operations Legal Team and senior legal management are fully briefed on major issues arising in the relevant business area and major legislative changes in area of expertise. Leadership & TeamworkSupport and assist the Head of the WPB Payments, Deposits & Bank Operations Legal Team in managing legal risk across the lines of the WPB business and digital and mobile channel teams and support functions in accordance with established policies and procedures. Maintain and develop positive and professional working relationships with all members of the Legal Team in managing legal risk across the lines of business in accordance with established policies and procedures. Participate effectively as part of the WPB Payments, Deposits & Bank Operations Legal Team. Share legal knowledge and best practices with legal colleagues. Manage internal support staff as appropriate. Operational Effectiveness & ControlProvide legal services in a cost-effective manner. Co-ordinate and manage the approach to legal risk for the WPB business and marketing teams. Ensure that the interests of the HSBC Group are adequately protected. Assist the WPB business and marketing teams to remain compliant with legal risk management requirements set out in the Group Standards Manual and Legal FIM. Maintain awareness of the operational risk scenario associated with the role and to ensure that all actions during employment with HSBC take account of the likelihood of operational risk occurring. Support the General Counsel of WPB in providing overall leadership over all regulatory and compliance matters and the management of operational risk for the department or WPB business and marketing teams. Ability to balance the need for further analysis and the need for a timely decision given commercial pressures. Management of RiskEnsure compliance, operational risk controls in accordance with HSBC or regulatory standards and policies; and optimize relations with regulators by addressing any issues. Observation of Internal ControlsMaintains HSBC internal control standards, including timely implementation of internal and external audit points together with any issues raised by external regulators. Qualifications Employment eligibility to work with HSBC in the U.S. is required as the company will not pursue visa sponsorship for these positionsMinimum of eight years proven and progressive corporate legal experience, or equivalent.Minimum of a Juris Doctorate degree as well as admission to applicable state Bar and pertinent levels of courts in applicable states. Strong advocacy, negotiation, interpersonal, organizational, legal research and verbal and written communication skills. Ability to quickly apply abstract concepts of law and make quick, innovative decisions to resolve problems. Ability to defend the Company and Group affiliates from claims and advocate their interests while maintaining their reputation for honesty and integrity. Proficiency with personal computers as well as pertinent mainframe systems and software packages.
